By using our Site and Ocean Style Elegant Escapes services through the Site, you agree to these Terms of Use and any additional terms applicable to certain programs in which you may elect to participate.
These Terms constitute a binding legal agreement (“Agreement,” though we may use “Terms” interchangeably with “Agreement” herein) in electronic form between you and Ocean Style Elegant Escapes and its successors, subsidiaries, affiliates and family of brands . IF YOU DO NOT AGREE TO THE TERMS, IMMEDIATELY STOP ACCESSING OR USING ANY OF THE SITE AND/OR SERVICES
CONDITIONS FOR USE OF THE SITE AND SERVICES
Your permission to use the Sites and/or Services is conditional upon your agreement that you:
- are 18 years of age or older;
- will comply with these Terms;
- have the authority to form a binding contract with us;
- Your use of this Site will at all times comply with the terms of this Agreement;
- If you elect to create an account you may create only one account for your personal use and for which you are wholly responsible
Terms of Sale
Deals you purchase through our Site are special promotional offers that you purchase from participating Vendors through our service. The deals for certain goods, services or experiences offered by, or facilitated through, the vendor/s identified in the deal. The Vendor is solely responsible for redeeming the deal. The Vendor is fully responsible for all goods and services it provides to you and for any and all injuries, illnesses, damages, claims, liabilities and costs (“Liabilities”) it may cause you to suffer, directly or indirectly, in full or in part, whether related to the use or redemption of the deal or not. You waive and release Ocean Style Elegant Escapes and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any Liabilities arising from or related to any act or omission of a Vendor in connection with the services/goods it provides in connection with the deal.
Hotel bookings are subject to availability of eligible participating hotels at the time of booking and all applicable terms and conditions.
By purchasing a deal you agree to the terms of this Agreement and these Terms of Sale, and any additional, deal specific terms outlined at the time of purchase (collectively, the “fine print” regardless of how labeled). These rules apply to all deals that we make available, unless a particular deal’s fine print states otherwise, and except as otherwise required by law. In the event of a conflict between these rules and a voucher’s fine print, the voucher’s fine print will control.
How it Works
Once you have placed your order, you will receive a confirmation of the Deal and your credit card or other payment mechanism will be charged for the amount of the Deal. We will further notify you by email within 48 24 hours, any further information and confirmation #numbers necessary to enable you to redeem the Deal purchased.
The “Fine Print”
In addition to the terms set forth herein, each Deal comes with its own set of restrictions, terms and conditions (the “Fine Print,” whether or not they are expressly labeled as such on a Voucher). The Fine Print may restrict things such as when or where you can use the deal as well as other deal-specific limitations, so always read carefully.
Deal Value
The values and discounts we display on our site are calculated based upon certain pricing information provided to us solely by Vendors, which may include the retail price suggested by the manufacturer, supplier or the Vendor, or an estimated price based on standard industry practice. Since the pricing information on which we base our discounts may vary, any discount information that we display may or may not be representative of the prevailing discount in every area or on any particular day.
Date Specific Events and Deals
Sometimes we offer Deals that are date-specific in which case you can only use the deal on the specified date. You may not reschedule a Date-Specific Deal for another date or time for any reason. For these date-specific deals, you may generally cancel within 24 hours of your purchase for a full refund. Thereafter, your purchase will be final and no full or partial refunds will be granted.
Opening acts, as well as individual performers, are subject to change or cancellation at any time without notice or recourse by you. Venues may search you as a condition of admission, ban or restrict certain items from being brought to the event and impose other rules on ticket-holders. You agree to all such rules and conditions and waive any related claims that may arise in conjunction with their imposition or execution. A ticket is a revocable license and admission may be refused for violation of the venue’s rules without refund, or for any or no reason upon refunding the amount paid. You voluntarily assume all risks and danger incidental to the event for which the Event Ticket is issued, whether occurring before, during or after the event, and you waive any claims for personal injury or death against Ocean Style Elegant Escapes, the venue, the issuer of the tickets and all of their respective affiliates, agents, officers, directors, owners and employees on behalf of yourself and any accompanying minor. You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of any event for which you purchase an Event Ticket. You agree that the event for which you purchase a ticket is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event.
THIRD PARTY WEBSITES
The Site contains links to websites maintained by other parties and we do not monitor or review the content. These links are provided solely as a convenience to you and not because we endorse or have an opinion about the contents on such websites. We expressly disclaim any representations regarding the content or accuracy of materials on such websites or the privacy practices of those websites.
LIMITATION OF LIABILITY
YOU AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR INTERACTIONS WITH THIRD-PARTY VENDORS AND IN NO EVENT SHALL Ocean Style Elegant Escapes , ITS SUBSIDIARIES, AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, VENDORS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE CONTENT, STATEMENTS AND OTHER INFORMATION CONTAINED THEREIN, THE PRODUCTS OR SERVICES ACCESSIBLE OR AVAILABLE THROUGH THE SITE, ANY ACTION OR INACTION BY A THIRD PARTY VENDOR OR THESE TERMS OF USE. IN NO EVENT WILL Ocean Style Elegant Escapes LIABILITY IN CONNECTION WITH A DEAL OR A PRODUCT OR SERVICE EXCEED THE AMOUNTS PAID FOR SUCH DEAL, PRODUCT OR SERVICE.
INDEMNIFICATION/RELEASE
You agree to defend, indemnify and hold harmless Ocean Style Elegant Escapes, its subsidiaries, affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys’ fees, arising out of or related to any products or services purchased by you in connection with the Site or any use of the Site in violation of these Terms.
You are solely responsible for your interactions with Vendors and other users of the Site. To the extent permitted under applicable laws, you hereby release Ocean Style Elegant Escapes from any and all claims or liability related to any product or service of a Vendor, any action or inaction by Vendor, including Vendors’ failure to comply with applicable law and/or failure to abide by the terms of a Deal, and any conduct or speech, whether online or offline, of any other user.
